What's the Hold Up Oklahoma?

General

What’s the Hold Up Oklahoma?  Woman Waits to Learn the Fate of Her Religious Freedoms While Life becomes More Complicated Day by Day.

Anyone who follows the work of the Constitutional Alliance is aware that one of our members, Kaye Beach, is embroiled in a legal battle that pits the states desire to collect and share personal biometric data against an individual’s right to religious freedom.

This woman has been without a valid driver’s license since Feb 28, 2011.  She is suing the state’s Department of Public Safety over the unwarranted collection of her personal biometric information as a condition for being granted a state driver’s license or identification card.

I have heard Real ID is dead. How do I separate Fact from Fiction?

General

The Real ID Act is a symptom, not the disease!!!    It is growing like a weed.

The fact is Real ID is not dead.  There is not a short cut that will allow me to explain the basis for my assessment.  Arguably, it is the taking of short cuts that has gotten us to where we are today.  We listen to sound bites or read short articles that only provide a snap shot at best of what the reality is.

Whether it is a lawmaker, state or national group/organization, or a private citizen there is not a day that goes by where I am not asked about the Real ID Act 2005.  Just this week I worked on proposed legislation that will be heard by state lawmakers from all across the country.  I was also asked by a well known national organization to do a comprehensive analysis of the Real ID Act 2005.  One state director of another national organization asked me to provide evidence that he could send to the national organization he belongs to who thought Real ID was dead.  Finally, this morning I received an email not unlike hundreds of others I have received, where a person whose driver’s license was up for renewal objected to forced biometric enrollment.  This person wanted to know what options she has.

The result of the requests for information led to this document – click here     The document is a comprehensive review of the Real ID Act with solutions provided.

Have you ever felt like you are on the wrong side of a one way mirror?

General

Government believes it is allowed to know everything about you but you have no right to know what government is doing!

Three issues are addressed within this communication.

  1. A posting in the Federal Register regarding a “closed meeting” being held by the Department of Homeland Security in 12 days.   One of the issues being covered is domestic violent extremism.
  2. Kaye Beach’s lawsuit to protect against the illegal/unconstitutional collection, retaining and sharing of her personal information.   In addition, the lawsuit focuses on Mrs. Beach’s religious freedom.
  3. State Representative Charles Key of Oklahoma has invited a Constitutional scholar to teach a class on the Constitution at the state capitol in Oklahoma.  Could this be the start of something that takes place at every state capitol?

Kaye Beach's lawsuit and how it directly relates to our liberty - an update also included

We want our leaders to read legislation before voting on it.  Will you read this document to protect your rights, liberty and freedom?)

L-I-B-E-R-T-Y Say it, "Liberty", now define what liberty means.  If a person cannot define liberty then how can a person know if they have liberty or not?  How can a person protect and preserve their liberty if they cannot define what liberty means?  At times we define things by what they are not; a sort of process of elimination.  Is “Liberty” consistent with needing the government's permission before you can buy, sell, travel or work?  This article will inform all citizens what they can do NOW to protect our rights, liberty and freedom.

If you decide not to read this communication, so be it.  I would ask those who do not read this entire communication, what are they doing to protect our constitutional rights that can result in change NOW, not when and if we ever have enough lawmakers that actually will honor their oaths to uphold our Constitution?

Yes, who we elect is important but we do not have time to wait until November 2012, much less January 2013 when those who win in 2012 actually take office.  Congress has multiple pieces of legislation (Photo Identification Security Act and Legal Workforce Act) before it NOW that would further erode our rights and thus liberty.  It is not enough to oppose what the government has and is doing by sending faxes or making phone calls to lawmakers. Individuals and groups must take action now to affect change.  Kaye Beach and her attorneys have and are taking action NOW.

Tuesday, September 8, 2011, the Supreme Court of the United States is expected to hear arguments in the “Jones” case.  Should law enforcement be able to go onto your property, attach a GPS (Global Positioning Satellite) device to your privately owned vehicle and subsequently track the vehicle as it leaves your property and travels in public, all without a warrant?  This is a very important case but I would and do argue Kaye Beach’s case is of equal or greater importance.

The Threat to the Church - Global Biometric Enrollment

(7 October 2011)  The Constitutional Alliance has received hundreds of inquiries about Kaye Beach's lawsuit.  Kaye's attorneys filed a petition/lawsuit on September 21st in Oklahoma.  Many people in many states are indicating a desire to do what Kaye Beach is doing.

There are two causes of action within Kaye's lawsuit.  One is based on the Oklahoma Religious Freedom Act.  The other is based on the Oklahoma State Constitution; Article II Section 30.  Article II Section 30 of the State of Oklahoma Constitution is essentially the same as the Fourth Amendment to the United States Constitution.

We need your contributions so we can work with people and groups in each state.

As citizens of the Untited States, we should not and must not require the permission nor approval of the federal government before we can buy, sell, travel, or work.  The federal government is aggressively seeking to know the who, what, how, when and where of our lives.  Kaye's lawsuit addresses the rights for Christians and non-Christians.

Many have asked if we are generally opposed to photographs on our driver license; we are not.  Any reasonable and prudent person can view a low resolution photo and readily match that photo to a person standing before them.  However, the high resolution digital facial image/photograph being demanded as a biometric allows people to be identified at distance in public without their knowledge nor direct consent.  Biometric collection of any kind should not be required as a prerequisite for obtaining a driver license.

Finally, we have been asked if Kaye's lawsuit interferes with law enforcement's criminal databases; the answer is no.

It is crunch time, every person is needed.  We ask that everyone share this information with all of the people and groups you are connected with.  We cannot stress enough, the importance of raising the funding so that our work with people across the country can proceed.  There is no contribution too small or insignificant, please contribute what you can.  We can't leave this for others to do.  Each person has an opportunity to take a partial stake in what Kaye Beach is doing and what the Constitutional Alliance is doing.  The government is taking action, now so must we, the people.

Thank you,

God Bless
